Service Description
GymReply provides AI-powered Instagram DM automation for gym businesses. Our service:
- Automatically responds to Instagram direct messages
- Uses AI to qualify leads and book trials
- Provides analytics and conversation management
Account Registration
To use GymReply, you must:
- Be at least 18 years old
- Provide accurate account information
- Maintain the security of your account credentials
- Be responsible for all activity under your account
- Own or manage the Instagram Business account you connect
Instagram Requirements
You must:
- Connect an Instagram Business account (not personal)
- Comply with Instagram's Terms of Service
- Comply with Meta's Platform Policies
- Have necessary rights to use Instagram for business purposes
- Not use the Service in violation of Instagram's policies
Subscription and Payments
Pricing
- Quick Replies: £14.99/month
- AI Sales Agent: £34.99/month
- Prices exclude applicable taxes
Billing
- Monthly subscriptions billed in advance
- Payment processed via Stripe
- Failed payments may result in service suspension
- No refunds for partial months
Cancellation
- Cancel anytime from your dashboard
- Service continues until end of billing period
- No refunds for unused time
- Data retained for 30 days after cancellation
Acceptable Use
You agree NOT to:
- Violate any laws or regulations
- Send spam or unsolicited messages
- Impersonate others or provide false information
- Interfere with the Service's operation
- Attempt to access other users' data
- Use the Service for illegal purposes
- Violate Instagram's or Meta's policies
- Harass, abuse, or harm others
Service Availability
- We aim for 99.9% uptime but do not guarantee it
- Scheduled maintenance will be announced when possible
- We are not liable for service interruptions
- Instagram API changes may affect functionality
Data and Privacy
- Your use of the Service is governed by our Privacy Policy
- We collect and use data as described in the Privacy Policy
- You retain ownership of your content
- We have a license to use your data to provide the Service
Instagram Compliance
GymReply complies with:
- Instagram's Platform Policy
- Meta's Business Tools Terms
- Instagram's API Terms
You are responsible for your own compliance with these terms.
Intellectual Property
- GymReply retains all rights to the Service
- You may not copy, modify, or reverse engineer the Service
- Our trademarks and branding are protected
- You grant us license to use your feedback for improvements
AI-Generated Content
- AI responses are generated automatically
- You are responsible for reviewing AI-generated messages
- We do not guarantee accuracy of AI responses
- You should monitor conversations for compliance
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Service provided "AS IS" without warranties
- We are not liable for indirect, incidental, or consequential damages
- Maximum liability limited to fees paid in past 12 months
- We are not liable for Instagram API changes or service disruptions
Indemnification
You agree to indemnify and hold harmless GymReply from:
- Your use of the Service
- Violation of these Terms
- Violation of third-party rights
- Content you provide or generate
Termination
We may terminate or suspend your account:
- For violation of these Terms
- For fraudulent activity
- If required by law
- At our discretion with 30 days notice (for convenience)
Changes to Terms
- We may modify these Terms at any time
- Changes effective immediately upon posting
- Continued use constitutes acceptance
- Material changes will be notified via email
Governing Law
- Governed by the laws of England and Wales
- Disputes subject to exclusive jurisdiction of English courts

Entire Agreement
These Terms constitute the entire agreement between you and GymReply.
Severability
